In short, a Rent Interdict Summons is a special type of Summons used in the Magistrates Court to sue for arrear rent, utilities and other damages associated with a tenant living on the property.

The benefits of a Rent Interdict Summons include:

  • It contains an automatic interdict against the tenant removing any assets on the property because these assets are subject to your landlord’s tacit hypothec (the assets are used as security for all arrear rent).
  • The Rent Interdict Summons allows the Sheriff to make an inventory (list) of all assets on the property. This inventory gives you an idea of the assets that gives you security for all arrear rent.
  • You do not need to approach the Magistrates Court for an interdict against the removal of the assets.
